Orders, Payments & Product Information

Orders placed through the Brendratti website are intended for individuals purchasing products for personal use. By submitting an order, you confirm that the products are not being purchased for resale, redistribution, or any commercial purpose, and that you are legally able to enter into a binding agreement under the laws applicable to you.

You may place an order by completing the checkout process and selecting the relevant “Place Order,” “Pay Now,” or similar button. Before submitting your order, please review all details carefully, including the products selected, quantities, delivery address, payment information, delivery charges, taxes, duties, and any other applicable fees. You are responsible for correcting any errors before completing your purchase.

The total amount payable will be shown at checkout. Product prices, delivery charges, taxes, duties, and other fees may vary depending on your location, selected currency, delivery method, and applicable exchange rates. The amount displayed at the time your order is submitted will apply to that order, unless an obvious pricing or technical error has occurred.

Available payment methods may differ depending on your location and the payment provider selected. By providing payment details, you confirm that the information is accurate, valid, and belongs to you or that you are authorized to use it. Your payment may be authorized when the order is placed, while the actual charge may occur immediately or when the products are prepared for dispatch, depending on the payment method and the terms of the relevant payment provider.

Brendratti may charge the full order amount even where products are dispatched separately, delivered in multiple shipments, or purchased as a pre-order. If payment cannot be completed or is declined, Brendratti may cancel the order and notify you accordingly.

Product descriptions, images, colors, measurements, and other information displayed on the Brendratti website are provided for general guidance. While Brendratti aims to ensure that product information is accurate, slight differences may occur between the images shown online and the product delivered, including differences in color, texture, finish, appearance, or packaging. Measurements may also vary slightly. You should review the product details carefully before placing an order and ensure that the product is suitable for your intended use.

Adding a product to your shopping bag or wishlist does not guarantee that the product will remain available. Products are offered subject to stock availability, and an item may become unavailable before your order is successfully submitted. If Brendratti is unable to fulfill an accepted order due to stock limitations, technical issues, or other circumstances, Brendratti may cancel the affected order or product and refund any amount already paid.

Nothing in these Terms limits or excludes any consumer rights, guarantees, warranties, or remedies that cannot legally be excluded or restricted under the applicable laws governing your purchase.

Order Acceptance and Confirmation

The information provided on the Brendratti website, including product details, prices, availability, and the information displayed during checkout, is an invitation for you to place an order. Submitting an order does not automatically create a contract between you and Brendratti. Your order will only be accepted, and a contract for the purchase of the relevant products will only be formed, when Brendratti sends you an email expressly confirming acceptance of your order (the “Order Confirmation”). Unless applicable law provides otherwise, the contract will be formed in the country from which the order is dispatched.

All orders may be subject to payment authorization, fraud prevention procedures, identity verification, sanctions screening, and other legal, regulatory, or security checks. Brendratti may request additional information or documents before accepting an order, particularly where there is a concern regarding the identity of the customer, delivery address, email address, payment details, or the authorized use of the selected payment method.

Brendratti reserves the right to refuse, suspend, or cancel an order, in whole or in part, before or after an Order Confirmation has been issued, where permitted by applicable law. This may occur if an order fails any required verification process, appears unusual or suspicious, is submitted in bad faith, is not placed by a genuine consumer, contains payment information that cannot be validated, or includes products that are unavailable.

An order may also be rejected or cancelled where there is an obvious error, technical problem, pricing mistake, inaccurate product information, or other genuine misunderstanding relating to a product, its price, description, availability, promotion, or the ordering process. For example, Brendratti may decline to honor an order where a product is shown at an exceptionally low price that is clearly inconsistent with its usual value and is not part of an advertised sale or promotion. Brendratti will not be required to fulfill an order affected by such an error, including where the error has been knowingly relied upon to purchase an unusually large quantity of products.

If Brendratti cancels or declines an order, or any part of it, for one of the reasons described above, any payment successfully received for the cancelled products will be refunded in accordance with these Terms. If payment has not been completed, no refund will be payable.

Brendratti may impose limits on the quantity of products that may be purchased by one customer, per order, household, delivery address, payment method, or within a particular period. Orders that exceed these limits may be refused or cancelled without prior notice, where legally permitted.

Unless applicable law requires otherwise, Brendratti is not obliged to provide a reason for refusing or cancelling an order, although it may provide an explanation at its discretion.

You also confirm that you have the legal capacity to enter into a binding contract under the laws applicable to you.

Placing a product in your shopping bag, wishlist, or saved items does not reserve that product or guarantee its availability. All products are subject to stock availability and may become unavailable before an order is submitted or accepted. If Brendratti cannot fulfill an accepted order because of stock shortages, technical problems, supplier issues, or other circumstances beyond its reasonable control, Brendratti may cancel the affected product or order and refund any amount already paid.

DUTIES and TAXES:
Taxes and Duties will be charged and collected at check out and charged with the global rate for each country. Please follow your Country tax code. Taxes will-may also be charged separately see your country tax rate upon delivery. We will charge for Shipping to that country including taxes and duties should they apply. 

Title, Risk, and Import Responsibilities

Ownership of the products purchased through the Brendratti website will pass to you once Brendratti, or its authorized payment or fulfillment partner, has received or is satisfied that it will receive full payment for the relevant order. The risk of loss, theft, or damage will transfer to you when the products are delivered to the delivery address provided during checkout. If you choose not to pay applicable duties and taxes in advance, delivery for this purpose may be treated as occurring at the relevant port of entry or customs location in the destination country.

Where products are shipped internationally, you will generally be treated as the importer of record. Brendratti, or a logistics provider acting on its behalf, may assist with customs procedures and may act as a customs declarant or agent solely to help process the shipment. Any such assistance does not change your responsibility as the importer for personal-use purposes.

You are responsible for confirming that the products you order may legally be imported into, received in, and used in the destination country or territory. You must comply with all applicable import laws, customs requirements, product regulations, safety rules, certifications, labeling requirements, and other standards that apply in the destination. Before placing an order, you should check whether the product is suitable for use in your location, including any differences in electrical, technical, safety, sizing, or regulatory standards.

A product will not normally be eligible for return, cancellation, or refund solely because it does not meet the standards, specifications, language requirements, or regulatory requirements of the destination country, where those differences were reasonably foreseeable or resulted from your decision to order the product for import. Brendratti will not be responsible for any loss, damage, delay, restriction, seizure, additional cost, or other consequence arising from your failure to confirm that the product is suitable or lawfully importable into your destination.

Please be aware that product packaging, care instructions, user guides, safety information, labels, warranty materials, or other documentation may not be provided in the language of your destination. Manufacturer support, repair services, replacement parts, or other after-sales services may also be unavailable or limited in your country. Products and accompanying materials may have been designed, labeled, packaged, or certified according to the requirements of the country from which they are shipped rather than those applicable in your destination.

You are responsible for any customs duties, import taxes, brokerage fees, handling charges, clearance costs, or other amounts imposed by the authorities or carriers in the destination country, unless the applicable charges are expressly collected from you at checkout. If you refuse delivery or fail to provide information required for customs clearance, you may remain responsible for any resulting costs, including return shipping, storage, disposal, or administrative charges.

If you provide a tax identification number, VAT number, or other information for the purpose of obtaining a tax exemption or reduced tax treatment, the transaction may still be treated as a personal import. By placing the order, you confirm that the products are intended for your own personal use and will not be resold, redistributed, or used for commercial purposes. You are responsible for ensuring that any tax exemption or relief claimed is accurate and legally available to you.

PRE-ORDER ONLINE:
All pre-orders will have a delivery date, the customer acknowledges these dates, it may take longer due to imports, as all our products are made in Italy. once the order is placed, the customer will be liable to pay for the products in advance. If for any reason they wish to cancel, it must be made within the time line listed below in the RETURNS and EXCHANGES Policy listed in the footer, except for Swimwear products which are non returnable by law.

ORDERING ONLINE:
The customer must complete orders online, the customer takes full responsibility for entering their address, phone, and shipping information, billing and payments information correctly. The customer is liable for completing the orders and submitting them online. All abandoned Carts are the responsibility of the customer. Brendratti is not responsible for the persons Information entered incorrectly into the on line store. The customer is liable for their information if any still listed in the store and not completed at check out. The customer will receive an order confirmation once the order is placed and if they did not receive one, please contact customer care at this e-mail: office@brendratti.com

Once the order is complete, it may take 3-7 days to process. The customer will be notified in an email if something is not available and offered a different style to replace or ask if they like to wait if on back order, or as for refund. The customer has the right to ask, if no reply is given, we will select the closest style and ship it, or hold until finalize by customer. Customer has 48 hours to finalize or make a claim, once order is placed. We cannot return/refund products once the order is placed. The customer is responsible to confirm and list their respected names and addresses for the correct shipping address to receive packages, It is the customers liability if the order is made in the wrong address and shipped to the wrong address.

PAYPAL or 3rd Party Conditions of any Payment: Brendratti is not liable for any payments taken from 3rd party Apps, such as PayPal, Apple Pay, Pay over time apps, or any 3rd party credit Bank Agencies; such as but limited to: AMEX, VISA , Mastercard, Discover Card payments for Securing any payments, returns or credits.

Brendratti has no knowledge of the 3rd party Apps and therefore no information about its customer through the 3rd party apps and therefore not liable for the information listed bout the client on those 3rd party apps.

All Returns through 3rd party apps, such as PayPal, but not limited to; the customer is liable and responsible to give the information to the 3rd party app and follow this apps request Prompts, and steps to complete and receive the return, Brendratti does not operate any Credit card, Bank Card, Bank debit account, Pay App's or any means of processing credit cards or taking payments and therefore is not liable. All payments are processed through these 3rd parties and should be taken up with said institution should the need arise.

Fulfilment, Handling, and Delivery

Brendratti may use third-party couriers, logistics companies, or other fulfilment providers to process and deliver your order. Certain products may not be available for delivery to all locations due to legal, product, or carrier restrictions. Any applicable restrictions may be shown during checkout, and Brendratti may cancel an order if delivery cannot lawfully be completed.

Delivery will be made to the address provided at checkout. Orders may arrive in separate shipments and on different dates. Unless otherwise stated, delivery estimates are not guaranteed, and orders will generally be delivered within the timeframe shown at checkout or, where no timeframe is provided, within 30 days of order confirmation, subject to exceptional circumstances.

Delivery times may be affected by the destination, selected shipping method, customs processing, carrier delays, weather, government action, or other events outside Brendratti’s reasonable control. Brendratti will not be responsible for delays caused by such circumstances or by incorrect or incomplete information provided by you.

If delivery is attempted, you are responsible for following the carrier’s instructions to arrange redelivery or collection. A carrier or fulfilment provider may contact you regarding delivery or returns.

You should inspect the package upon arrival. If it appears open or damaged and notify the carrier and Brendratti right away. Brendratti is not responsible for 3rd party or fulfillment center handling of packages due to out of our control, kindly advise.

LEGAL USE OF TRADEMARK:

Customer may not resale any Brendratti products, garments, name to other retailers online, 3rd party shops online or any boutiques without permission by Brendratti trademark design name. It is forbidden to use the name or its mark Brendratti, or its campaign imagery or anything from the Brendratti brand website, packaging logo and the like.

3rd party wholesale is it strictly prohibited to resale any or all Brendratti products to any discount shops, boutiques, online store such a s but not limited to: eBay, Amazon, discounters, discount websites without written permits from Brendratti and its legal team, it’s is strictly prohibited.

INTELLECTUAL PROPERTY RIGHTS: 

All intellectual property displayed on or connected with the Brendratti website, including the Brendratti name, trademarks, logos, product designs, images, illustrations, graphics, text, packaging, accessories, layouts, and other distinctive materials, whether registered or unregistered, is owned by or licensed to Brendratti and remains the exclusive property of Brendratti or its relevant licensors.

You may not copy, reproduce, modify, adapt, publish, distribute, transmit, display, sell, license, create derivative works from, or otherwise use any Brendratti intellectual property, in whole or in part, without Brendratti’s prior written permission. This prohibition applies regardless of the purpose or medium used and includes combining Brendratti trademarks, logos, designs, or other distinctive elements with any third-party trademark, symbol, logo, or branding in a way that may create a composite or misleading identity.

These restrictions also apply to all copyright works, product designs, drawings, models, photographs, videos, written content, software, and other protected materials made available through the Brendratti website or in connection with Brendratti products.

You may access and use the Brendratti website solely for your personal, private, and non-commercial purposes. Any downloading, copying, reproduction, transmission, publication, distribution, or representation of all or any part of the website or its content for commercial purposes or for purposes unrelated to placing or managing a genuine order is prohibited unless expressly authorized by Brendratti in writing.

Nothing in these Terms grants you any ownership interest or other rights in Brendratti’s intellectual property, except for the limited right to use the website in accordance with these Terms.

Governing Law and Jurisdiction:

These Terms and any purchase made through the Brendratti website are governed by the laws of the State of California and the applicable federal laws of the United States, without regard to conflict-of-law principles. However, if mandatory consumer protection laws or other non-waivable legal requirements in your state or country of residence apply to your purchase, those laws will continue to apply to the extent required.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision will be modified or enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

To the fullest extent permitted by law, you and Brendratti agree to waive any right to a jury trial in connection with any dispute, claim, action, or proceeding arising out of or relating to these Terms, your use of the Brendratti website, or any purchase made through the website.

Before commencing formal legal proceedings, the parties are encouraged to contact one another in this case Brendratti, Inc Legal team and attempt to resolve any dispute informally. You may also have rights to pursue complaints through applicable consumer protection agencies, alternative dispute resolution services, or other procedures available under California or federal law.
